Coming Soon - Anwar VS Mahathir



The High Court here today fixed March 7 for case management of the defamation suit brought by Datuk Seri Anwar Ibrahim against former prime minister Tun Dr Mahathir Mohamad for accusing him of being a homosexual.


Bernama reports that Judicial Commissioner Datuk Tengku Maimon Tuan Mat fixed the date in chambers. Anwar was represented by counsel S.N.Nair, while counsel Datuk V.K.Lingam and Datuk V.Sithambaram appeared for Mahathir.

In his statement of claim, Anwar said Mahathir was fully aware that his remarks were mainly aimed at humiliating him in his personal and official capacity as former finance minister and deputy prime minister and that they would be published in the local and foreign media.

Besides general and exemplary damages, Anwar is also seeking an injunction to stop Mahathir or his agents from uttering or publishing such remarks in future.

Mahathir, in his statement of defence, said he relied on qualified privilege as former prime minister in making the statement.

He said the remarks were made at a conference organised by the Malaysian Human Rights Commission (Suhakam) where qualified privilege was applicable as spelt out in the Defamation Act 1957.

Mahathir also said the Sept 9, 2005, remarks were made in the interest of the public and it was his moral duty to inform them of Anwar's misconduct.


Media Statement: Suit against Dr. Mahathir

Dr. Mahathir has made a scurrilous and utterly reckless accusation about my character. If he believes that he is justified in saying that he must have the moral courage to face me in court.

This latest attempt on his part after two years to dismiss my suit without resorting to a trial clearly indicates he has no moral ground whatsoever to stand on.

He knows I have evidence which when exposed in open court will confirm all the statements I have made about his gross abuse of power, autocratic ways and corrupt practices during his rule.

I reiterate my challenge to set up an independent commission to investigate the billions of ringgit he has amassed while in power, his role in the dismissal of the Lord President Tun Salleh Abbas and Federal Court Judges as well as the repressive acts against dissidents and opposition leaders.

So, Mahathir, do you know why, no matter how much money you gave to the UMNO kronies and your family, in the end, they still end up owing people money? It is because they always have to depend on others for technology and know how.

And no matter how much money, you feed to those Bumiputra, in the end, they are not self sufficient and always asking for more and more and more. It never ends.

And do you know, there won't be any recognition to all GLCs and Bumi companies from abroad and fellow malaysians because they did not earn it. They were given by the Malay goverment.

PAS capitalised from Malay reaction to the Anwar persecution, but they squandered the opportunity to make the government accountable by focussing on atavistic Islamic rhetoric which provided no solution to our manifold problems. In fact PAS divided Malaysian society further, here on a religious front. UMNO divided us racially which is its modus operandi. Mahathir thought he could pull the rug from under PAS' feet by illegally declaring Malaysia an Islamic State but this had a catastrophic effect of further entrenching Islamic rhetoric in the political domain as both PAS and UMNO tried to out-Islamise each other. The paradox was that as this was happening, there was no improvement in the moral fibre of the nation- corruption, injustice, exploitation, racism, religious bigotry, environmental destruction, moral decadence continued inexorably.

To show how truly 'Islamic' UMNO was, it destroyed the Ayah Pin commune in Terengganu in a most vicious and inhumane way. All the 'Islamic' nonsense which we see going on today - raiding of the Zouk club, the wanton destruction of Hindu temples the Khalwat raids, the Rayapan case & the Moorthy case, the non- recognition of Lina joy as a Christian, the opposition to the IFC is a result of Mahathir's illegal declaration of Malaysia as an Islamic State. This I believe is his most damaging legacy.





Sportcheck: Fund abused by three bodies !

NEGRI Sembilan, Pahang and Penang have abused the funds and assistance provided to them under the Core Sports programme.


Pahang

The Pahang Hockey Association (PHA) has yet to settle allowances owed to its coaches or submit its accounts for the core sports since 2005.

In total, the PHA has yet to account for RM58,000.

To make the situation worse, its honorary secretary Dr Abdul Aziz has never attended a single core sports meeting in Pahang.

Frustrated with the lack of support, the committee has decided to, in future, issue payments through the State’s chief coach.

"We have sent several reminders to Pahang and have also asked its secretary to attend the meeting, but they have failed to do so," said Core Sports head of unit Jefri Ngadirin when asked to comment on the States that have misused the funds provided by the Core Sports Steering Committee.

"We are aware that it’s a voluntary position, but it’s also their responsibility to ensure support is given towards the development of the sport."


Penang

On Dec 29, Penang State Hockey Association (PSHA) secretary Ranjit Singh accused the Steering Committee, which is headed by Tan Sri Noordin Hassan, of losing its direction and trying to control the sport in the States.

Under the Core Sports programme, hockey has 104 centres with some 4,000 players between the ages of 12 and 15 being given training all year-round.

Another sore point is Penang’s continued rental of a house to conduct its business.

Under the MOU signed between the National Sports Council (NSC), State associations and national associations, the core sports committee will pay RM1,200 a month for rental and RM1,000 for administration.

However, State associations are supposed to rent only office blocks, not houses.

But PSHA has rented a house with a tenancy agreement signed in 2005.

And that has prompted the committee to propose a freeze on the allocation to State associations to rent office premises.



Negri Sembilan

Core Sports’ manager of coaches for hockey R. Vivekanandan also confirmed that Negri used the funds allocated for core sports programmes to prepare their team for the Razak Cup.

The funds are only to be used for development programmes for those below the age of 18.

"Negri was given the responsibility to organise a coaching course during the National Under-14 tournament and the association sent a bill of RM25 per participant for food. However, they were only served noodles and coffee for breakfast," said Vivekanandan.

"The participants were upset because they were not even served proper meals for lunch and dinner."

"And the PSHA chose to send a 14-year-old to attend an umpiring course because it was free.

"I don’t deny that there are late payments on our part but the programme started just one year ago. But rest assured that all payments due will be paid."
